Ground rules for fair collaboration
Terms and Conditions
These terms govern the use of ShootingPlaner, its project features and related sharing functions.
1. Provider and scope
The provider of ShootingPlaner is [Rechtlichen Namen oder Firma ergänzen]. Address: [Vollständige Postadresse ergänzen]. Contact: support@shootingplaner.ch.
These terms apply to registered account holders and, where relevant, invited participants and people using a shared project or album view. Different terms apply only if the provider expressly agrees to them in text form.
2. Account and formation of contract
A user agreement is formed after successful registration and email confirmation or the first sign-in through an offered identity provider. Information must be accurate and kept current; credentials must not be shared.
Users must have legal capacity or act with the consent of their legal representative. A person sending invitations must be entitled to use the recipients’ contact details.
3. Trial, free plan and planned paid plans
New accounts receive the advertised full feature set for 14 days within the free plan’s quantity limits. Afterwards, 1 GB storage, two active projects and three participants remain available; image ratings, subalbums, locations, packing lists, reference images and date finding are disabled.
Paid plans are currently marked as planned on the landing page. No paid subscription is formed until a binding checkout states the total price, term, renewal and cancellation rules. Separate payment terms must be added before activation.
4. Services and changes
ShootingPlaner supports private photo-shoot planning, including ideas, participants, dates, locations, timelines, packing lists, galleries, ratings, downloads and project-related contract records. The current published plan description defines the exact scope.
The provider may improve features if the contractual purpose remains intact and users are not unreasonably disadvantaged. Internet access, suitable devices and local backups are not part of the service.
5. Duties and prohibited use
Users are responsible for their content and actions. Illegal, defamatory, discriminatory or clearly pornographic content, malware, automated overload, bypassing access controls and infringements of copyright, trademark, privacy or data-protection rights are prohibited.
Anyone inviting people, uploading images, recording locations or sharing links must hold all necessary rights and permissions. Sharing links and tokens must be kept confidential.
6. Rights to content
All rights to uploaded images, text and other content remain with their owners. For the contract term, users grant the provider a simple, geographically necessary right limited to operating the service, including storage, technical processing, preview generation and access according to the selected sharing settings.
This does not include advertising use or AI-model training. Users indemnify the provider against justified third-party claims to the extent they are responsible for the infringement.
7. Sharing and collaboration
Project owners set roles, access, album sharing and download permissions. Invited people may use information only within the granted scope. Ratings, availability and other contributions may be visible to other authorised project members.
Token-based links allow access without an account. Passing on such a link effectively widens the potential audience and remains the sender’s responsibility. Compromised or abused shares may be blocked.
8. Availability and backups
Continuous availability is not promised. Maintenance, security measures, network or supplier failures and events outside the provider’s control may temporarily restrict use.
ShootingPlaner is not a substitute for an independent archive. Users should keep original images and important documents elsewhere. Appropriate safeguards are used, but recovery from an individual backup is not guaranteed.
9. Suspension, termination and deletion
Accounts may be suspended or terminated for cause in case of serious or repeated breaches, security risks or legal obligations. Where reasonable, users will be informed first and given an opportunity to respond.
Ordinary cancellation rules for future paid plans will be defined before activation. On termination, content is removed under the published retention rules unless law or legitimate evidentiary needs require otherwise. Required content must be exported beforehand.
10. Liability
Liability is unlimited for damage caused intentionally or by gross negligence and where mandatory law requires it. For slight negligence, liability is limited where permitted to foreseeable loss caused by breach of an essential contractual duty.
The provider is not liable for user content, unauthorised forwarding of sharing links, missing local backups or events outside its responsibility. Mandatory consumer rights remain unaffected.
11. Privacy and amendments
Information about personal-data processing is provided in the Privacy Policy. Material changes to these terms will be announced in good time. Changes do not apply retroactively; mandatory rights and agreed core services remain protected.
12. Applicable law and jurisdiction
Swiss law applies, excluding conflict-of-law rules. Mandatory protections at a consumer’s habitual residence remain reserved. Statutory consumer venues apply; otherwise the provider’s registered office is the place of jurisdiction.
